Nurse Denies Using Offensive Language in Transgender Doctor Changing Room Row
A nurse suspended for objecting to a transgender doctor in a changing room denies using offensive language during the incident

Ms. Peggie claims she never used the word “rapist” or mentioned “chromosomes.” She filed a complaint against NHS Fife and Dr. Upton, citing several issues under the Equality Act 2010.
She felt uncomfortable after Dr. Upton used the changing room three times in 2023. Ms. Peggie has worked for NHS Fife since 1994 and met Dr. Upton in August 2023.
During the tribunal, she described Dr. Upton as looking male. Other colleagues shared her concerns, and a manager promised to address the issue. Ms. Peggie was suspended in January 2024 without explanation.
She learned of allegations against her later that month. Her suspension was reinstated in April after her lawyer requested changes regarding Dr. Upton’s access to the changing room.
Ms. Peggie returned to work, but the investigation continued. She felt the process was delaying her return. She insisted the Christmas Eve incident was not a confrontation and denied using offensive language.
She stated she was already in the area when Dr. Upton entered the changing room. Ms. Peggie expressed discomfort seeing Dr. Upton in the changing room and felt embarrassed.
She clarified that she had no issue with Dr. Upton personally, just with her using the female changing room. Ms. Peggie denied any discrimination or harassment.
The barrister for NHS Fife argued that Ms. Peggie’s complaint was about Dr. Upton’s presence, not her actions. The tribunal is ongoing.
