Mumbai: It’s been over 14 years since Nasir Khan tragically fell from a crowded train, and now the Bombay High Court has stepped in. They’ve ordered the Railways to pay his parents ₹8 lakh within eight weeks. That’s a long time to wait for justice, right?

The court found enough evidence to show that Nasir’s fall was an accident, which qualifies for compensation under the Railways Act. They looked at police reports, medical records, and affidavits that all pointed to the same conclusion. Justice Firdosh Pooniwalla made it clear that the evidence showed Nasir fell from the train at Sandhurst Road.

Back on May 8, 2010, Nasir was traveling with a valid monthly pass when he fell from a local train. He was rushed to JJ Hospital but sadly didn’t make it. His parents, Basir and Amina Khan, initially sought compensation from the Railways Claims Tribunal, but their claim was rejected in 2014. The tribunal argued that Nasir wasn’t a legitimate passenger since no ticket was found on him.

But the High Court didn’t buy that. They pointed out that the inquest and injury reports confirmed Nasir’s fall and injuries were consistent with an accident. Justice Pooniwalla emphasized that just because a ticket wasn’t found doesn’t mean he wasn’t a bonafide passenger. The court said the parents had shown he had a valid pass, shifting the burden of proof back to the Railways.

In the end, the court ordered the Railways to pay ₹4 lakh to each parent. If they don’t pay up in time, interest will kick in at 7%. It’s a bittersweet victory, but at least it’s something after all these years.
