Judge Set to Decide on NYC Congestion Pricing Injunction Soon
A federal judge in Manhattan will soon rule on an injunction to halt NYC’s congestion pricing program before it starts on January 5

Judge Lewis Liman mentioned he understands the urgency of the situation. Lawyers from the Trucking Association of New York, along with some Manhattan residents and teachers, are pushing for an injunction to block this toll plan. They argue that the pricing is unfair, hitting trucks harder than taxis and other vehicles.
The current plan charges regular cars $9 a day to enter the congestion zone, while trucks face fees ranging from $14.40 to $21.60, depending on their size. The trucking lawyers are saying this just isn’t right and are looking for a fairer system.
The pricing structure is based on vehicle size and use, with motorcycles getting lower tolls and trucks facing the highest charges. Taxis and rideshares like Uber and Lyft will pass their tolls onto passengers, which could add up quickly.
Judge Liman even questioned the trucking lawyer about whether trucks contribute to congestion, hinting that they might be a big part of the problem. If he sides with the plaintiffs, the congestion pricing could be paused while the legal issues are sorted out. If not, the plan will move forward as scheduled.
The MTA is also in the mix, asking the judge to dismiss the case without a trial. Liman plans to hold a conference after he makes his decision on the injunction, which will happen before he looks at the MTA’s request.
This congestion pricing plan was recently revived by Governor Hochul, who lowered the tolls after pausing it back in June. It’s a requirement under New York State law to help fund a $15 billion bond for the MTA’s budget.
This case in Manhattan is just one of several legal battles happening as the start date approaches. There are also hearings scheduled in Westchester and New Jersey regarding the toll plan, so it’s definitely a busy time for everyone involved.
