Dion Barber is taking the state of Western Australia to court. He’s claiming he suffered horrific sexual abuse while in the care of family members during the 1980s and 90s. It’s a tough story to hear.
His lawyer, Joel Sheldrick, argues that the Department of Communities failed him. They had a duty to protect him, but instead, they let the abuse happen while he was under their guardianship.
Sheldrick plans to show how the abuse affected Dion’s life, which he first reported when he was just eight. It’s heartbreaking to think about what he went through.
He mentioned that they’re seeking damages for the time until Dion turned 18. Even after the wardship ended, he still deserved protection from the state.
Sheldrick emphasized that the wardship should never have ended. He believes the duty of care was clear, and it’s shocking that there’s even a dispute about it.
On Tuesday, he reiterated how serious the guardianship was. What happened after Dion was placed back with family was “inexcusable and appalling.” It’s hard to wrap your head around that kind of negligence.
Authorities didn’t check if his relatives were fit to care for him. They even ignored complaints about abuse and left him in unsafe homes. It’s just mind-boggling.
In one instance, they put him back with his stepfather, who had already been found guilty of abusing him. How could that happen?
Sheldrick pointed out that this was a child in urgent need of protection, yet he was placed right back in harm’s way. It’s a tragic situation.
The defense lawyers are set to start their statements soon, and the trial is still ongoing. Let’s hope justice is served for Dion.
